All contracts for both property selling or purchasing are tailor-made for you by our lawyers. They help the sellers and purchasers to reach the agreement on all the transfer conditions which are to be embodied in the contracts. They also take care of all the communication with the cadaster.

RESERVATION AGREEMENT

The purchaser commits to purchasing a property by signing the reservation agreement where both the purchase price and way of payment are agreed upon. It defines in particular the reservation period, i.e. the date until the purchase agreement (or the contract of the future purchase) is to be signed.

PURCHASE AGREEMENT

Purchase agreement is a pillar of the property transfer. Besides stating the purchase price, it arranges the fundamental timeline–when is the purchase price to be deposited, when is the property to be handed over and the date of transferring the ownership rights at the cadaster. Our layers will help you to plan everything to satisfy both parties and they will oversee the transaction to secure the whole process.

PURCHASE PRICE DEPOSIT

The fundament of a correct property transfer is a safe purchase price deposit.

Between signing the purchase agreement and transferring of the ownership rights, it is necessary to deposit the purchase price to a third party, a reliable subject. You can choose from three options–attorney deposit (or else notary deposit), bank deposit, or depositing at the estate agency.

BANK DEPOSIT

The bank deposit is compulsory should the purchase price be paid with a mortgage loan. As a matter-of-fact, banks are the safest deposit keepers as all bank institutions are subjects to Czech National Bank supervision. However, depositing in a bank is usually more costly than depositing at an attorney or an estate agency. A low agreement flexibility is yet another disadvantage of bank deposits.

ATTORNEY DEPOSIT

An attorney can compose a tailor-made deposit agreement for you, but you have to exercise caution when choosing the right attorney–there might be a risk of losing the funds. Moreover, both the seller and purchaser have to agree on the choice of a trustworthy person. Maxima reality cooperates with Mgr. Šárka Smetanová in matters of deposit.

DEPOSIT AT ESTATE AGENCIES

Following a new Estate Intermediation law, an estate agency can keep a deposit only when asked to do so in writing by the seller and has to keep the clients' money on an account strictly separated from its operating accounts. These standards are observed in Maxima reality for a long time already–on top of that we strictly double-check every step and utilise payments authorisations.
